1. Agreement
By downloading and using Breathe With Me, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use the app.
2. What Breathe With Me Is — and Isn't
Breathe With Me is a contemplative-practice and breathwork companion designed to support personal reflection and mindfulness. The app is not medical, psychiatric, or therapeutic advice and is not a substitute for care from a licensed healthcare professional. If you are experiencing a mental-health crisis, please contact a crisis helpline or emergency services in your area.
3. Health and Safety
Some breathwork practices involve breath retention, body locks, extended exhalation patterns, or other techniques that can produce physiological effects including lightheadedness, dizziness, or changes in heart rate. Always practice in a safe, stable environment. Never practice while driving, operating machinery, in water, at heights, or in any context where momentary lightheadedness could be dangerous.
If you are pregnant, have a cardiovascular or respiratory condition, a seizure disorder, or any other medical condition that breathing practices could affect, consult a qualified physician before beginning. Stop any practice immediately if it feels unsafe or causes discomfort you are not prepared for.
4. Contemplative-Practice Framing
The teachings and techniques in this app are drawn from contemplative traditions including yoga, pranayama, mantra, and various breathwork lineages. They are offered with deep respect for their origins. Practitioners and teachers credited within the app are named. Use of these teachings does not constitute initiation into any lineage and does not replace the relationship between a student and a qualified, in-person teacher. These practices are offered as a support to your own spiritual or wellness journey, not as a substitute for study with a teacher.
5. Your Account
You are responsible for the email address you use to register and for all activity that occurs under your account. Sign-in is secured by a one-time-use link sent to your email. Treat that link as sensitive and do not share it with others. You are responsible for maintaining the confidentiality of your account.
6. Acceptable Use
Do not attempt to break, reverse-engineer, hack, or attack the app or its services. Do not use the app to harm yourself or others. Do not upload, publish, or share illegal content. (The primary user-writable feature is your own personal check-in journal, which remains yours and is not shared publicly.)
7. Content Ownership — Your Check-ins
Any text, reflections, or notes you write in a check-in are your own, and Breathe With Me does not claim ownership of your check-in content. The Privacy Policy describes where this content is stored and how it's handled.
8. Breathe With Me Content
All audio recordings, written guidance, technique descriptions, images, and other materials created by or for Breathe With Me are provided to you for personal practice only. You may not redistribute, republish, remix, or repackage this content without explicit written permission. This includes uploading it to other platforms, sharing it in groups or communities, or using it in derivative works.
9. Subscriptions and Payment
Breathe With Me Phase 1 (current release) is free to use. If paid features or subscription tiers are introduced in future releases, specific terms governing payment, billing, cancellation, and refunds will be added to this section.
10. Termination
You may stop using the app at any time. You may also request deletion of your account and all associated data at any time (see "Deleting Your Data" in the Privacy Policy for the account deletion process). Breathe With Me may suspend or terminate access to an account that violates these terms.
11. Disclaimers
The app and its content are provided on an "as-is" basis. To the maximum extent permitted by applicable law, Breathe With Me disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Breathe With Me does not warrant that the app will operate without interruption, that it will be error-free, or that any defects will be corrected.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Breathe With Me's total liability for any claim, damage, or loss arising from your use of the app is limited to the total amount you paid to Breathe With Me in the twelve months before the claim arose. During the free Phase 1 beta, this amount is zero. In no event shall Breathe With Me be liable for incidental, indirect, special, consequential, or punitive damages.
13. Changes to These Terms
Breathe With Me may update these terms from time to time. When a material change is made, the "Last revised" date at the top of this document will be updated. You may be prompted to review and acknowledge the updated terms within the app. Your continued use of the app after an update constitutes acceptance of the new terms.
14. Governing Law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms or your use of the app will be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.
